Epic Games has filed a stylemark infraction lawsuit against Nreal, saying (you whitethorn take over already patterned this out) that its use up of the name Nreal Light for its upcoming mixed reality specs comes a bit too close for consolation to its multiple "Unreal" trademarks.

The trouble isn't just the similarity of the names, which is provable, but the alleged intersection 'tween Epic's and Nreal's products: The lawsuit claims, e.g., that Nreal has already developed a game for its Nreal Light, and that its website lists the Unreal Engine as one of three exploitation platforms for Nreal spectacles.

"Nreal's use of NREAL, a trademark that looks and sounds virtually identical to Big's Fictional trademark, in connection with products that convergence with Large's UNREAL-branded products and services is likely to confuse consumers," the suit states. "Not only has Nreal aimed its first product at a section into which Epic has already entered, Nreal's plans let in further impact on Epos's rights."

The suit states that Nreal's trademark filing indicates that information technology intends to use the earmark not just for its AR eyeglasses, but for "[d]esign and development of computer game software and virtual reality software," which would shuffle it a direct competitor to the Unreal Railway locomotive. It's also targeting the same industries as Epic, including "gaming, amusement, retail, medical, office environments, industry, and another marketplace segments."

Nreal filed its stylemark application in January 2018, which Epical formally opposed in December of that year "attributable the likelihood of confusion" 'tween the cardinal trademarks. Since then, the two companies have unsuccessful to negotiate a result, but haven't been healthy to piece of work anything out. The count became more imperative in August 2020, when Nreal began selling its Nreal Light in Japan and Germany, and announced that a launch in the United States would happen later this year, with support from some bad serious embodied partners.

"If permitted to continue, Nreal's use of the Infringing Marks bequeath impairment and irreparably offend Epic, the UNREAL Marks, and Epic's report and goodwill associated with the Delusory Marks," the causa states. "Nreal should not be permitted to reap the benefits of Epic's extensive efforts to build a valuable brand in its UNREAL Marks or, with funding from the hearty marketing budgets of its significant business partners(Samsung, LG, and Deutsche Telecom), swamp the power of Epical to enlarge its offerings under the UNREAL Marks without being related to with Nreal."

Heroic poem is quest an order directing Nreal to withdraw its trademark application, plus damages, legal fees, and restitution.

"We're cognisant of the judicial proceeding that has been filed by Epic," an Nreal spokesperson said in a statement. "We respect intellectual property rights, only we think that this cause lacks merit and architectural plan to defend vigorously against the claims brought by Epic."

Nreal likewise recently tweeted that "something you've all been waiting for" will equal revealed on May 20.
